National Interest Waiver

A National Interest Waiver (NIW) is a category of EB-2 visa reserved for individuals who have exceptional abilities and whose employment in the US would greatly benefit the nation. Unlike other applications for work visas, those seeking a NIW can self-petition, without the requirement of a job offer or other assistance from their employer.

Those with advanced degrees and/or exceptional abilities in the sciences, arts, or business are generally qualified to self-petition for an NIW. This includes researchers with a demonstrable record of publications or academic achievements, entrepreneurs whose startup enterprises are likely to boost job growth, or physicians agreeing to work for a period of time in a designated underserved area.

Additionally, seeking a NIW may also make you eligible to apply to adjust your status and become a Legal Permanent Resident of the US.
